Kiwanda Coastal Properties
Thank you for placing a reservation with Kiwanda Coastal Properties Vacation Rental Management (“Agent”). Your reservation is secured with your credit card. This Short-Term Rental Agreement (“Agreement”) is made by and between Kiwanda Coastal Properties (“Agent”) and the individual completing the booking (“Primary Guest”) and applies to all occupants and visitors of the Property.By accepting this Agreement electronically, booking through any platform, or occupying the Property, you confirm you have read, understand, and agree to all terms and conditions contained herein. The Property description, occupancy limits, parking information, and rules listed on the website or booking platform (“Property Description”) are incorporated into this Agreement.
Tillamook County has strict rules for Short-Term Rentals, and violations or fines issued during a Guest stay can jeopardize the Property’s ability to continue operating as a rental. Guests agree to comply with all local STR ordinances including noise, occupancy, parking, garbage, fire, and safety regulations. Any violation of law or STR ordinance will result in immediate eviction with no refund. Significant rules include: occupancy and parking restrictions enforced throughout the stay (including day use), quiet hours 10pm–7am, and no fireworks at STRs.
Primary Guest Definition
The “Primary Guest” is the person who books the reservation, provides payment, is over the age of 24, signs this Agreement, and is present for the entire duration of the stay. The Primary Guest is legally and financially responsible for the Property, all occupants, and all visitors for the entirety of the reservation. Third-party bookings are not allowed. Total occupancy must be disclosed.
Payment Terms
Guest agrees to pay 25% of the total reservation cost at the time of booking. The remaining balance is due 14 days prior to check-in and may be automatically charged when applicable. Visa, MasterCard, Discover, checks, and cash are accepted. Third-party booking platforms may have alternate payment schedules.
Guest acknowledges full responsibility for all fees, taxes, damages, penalties, and charges incurred. Guest remains liable for all balances not paid by the credit card company, and Agent has the right to collect such amounts through any lawful means.
Cancellation Policy
1/2 the total cost of the Booking is subject to forfeiture if reservation is canceled or changed within 30 days of arrival. 100% of rental rate is charged if cancelled (or no-show) within 14 days of arrival. If the house is fully rebooked by another renter, cancellation charges (less $35) will be refunded. Reservation cancellation fee is $35. If you do not book direct, and instead book through a third party, additional fees and refund and deposit policies may apply (but all other terms and conditions of this Agreement remain the same). Please review the policies of any third party booking sites prior to confirming your booking.
Occupancy, Parking & Use of Property
Occupancy and parking limits stated in the Property Description are strictly enforced during the entire stay. All guests must be responsible adults 24+, relatives of the Primary Guest, or minors accompanied by their legal guardian. Day-use visitors require prior approval. Events, gatherings, and parties are not allowed.
If additional vehicles are needed, contact Agent for pre-approval. Parking is permitted only in designated areas. No tents, canopies, trailers, RVs, boats, or oversized vehicles are allowed without written authorization.
This is a short-term, nightly accommodation and does not constitute a lease. Property may not be used as a primary residence. The Property may not be used for commercial purposes, staged photo shoots, or marketing content. Unauthorized commercial activity incurs a $1,000 fine.
Guests may not rearrange furniture, move mattresses, install appliances, or alter the Property in any way.
Weather, Coastal Conditions & Power Outages
The Oregon Coast experiences windstorms, king tides, flooding, and frequent power and internet outages. Guest understands and agrees that:
• No refunds or compensation are provided for storms, outages, road conditions, or natural coastal events
• Guest must secure all doors, windows, hot tub lids, umbrellas, BBQ covers, and outdoor furniture during wind events
• Garage doors may not be opened during wind advisories
• Agent cannot guarantee uninterrupted utilities
Guest assumes all risks associated with coastal weather.
Access & Entry
Agent, staff, and authorized vendors may enter the Property at any time for emergencies, required repairs, safety or damage verification, compliance checks (occupancy, parking, noise), and county/HOA inspections. Reasonable notice will be given when feasible.
Pet Policy
Pets are limited to housebroken dogs only and only at designated pet-friendly homes. Some homes allow only 1 dog; no home allows more than 2 without approval. Dogs may not be left unattended unless kenneled. No pets on furniture or bedding. Outdoor waste must be removed.
Unauthorized pets incur a $500 fee and pet evidence in a non-pet home will result in additional charges.
Behavior, Noise & Neighborhood Respect
Quiet hours are 10PM–7AM as required by county ordinance. Audible outdoor noise during quiet hours is prohibited. Guest must lock all doors and windows, secure personal belongings, and ensure peaceful enjoyment for neighbors. Violation may result in eviction with no refund.
No Smoking, Drugs, or Illegal Activity
Smoking, vaping, illegal drugs, psilocybin, and all illegal activity are strictly prohibited anywhere on the Property.
Damage, Cleaning & Additional Charges
Guest acknowledges and agrees that they are fully and financially responsible for any and all damage to the Property, its furnishings, décor, equipment, appliances, hot tub, linens, flooring, walls, outdoor areas, or contents caused by any occupant, visitor, or pet—whether authorized or unauthorized—during the reservation period. This includes accidental damage, negligent damage, misuse, abuse, theft, or removal of any items.
At the discretion of Management, security deposits (if collected) may be held and/or additional charges may be assessed for damage, additional cleaning, excessive garbage, or any non-compliance with this Agreement. Guest will be supplied with an accounting of such charges. Guest remains responsible for all costs and acknowledges that unpaid amounts may be subject to collection action, legal fees, and all remedies available under law.
Guest authorizes Agent to automatically charge the credit card on file for:
• Unauthorized pet – $500
• Pet waste cleanup – $100
• Excessive cleaning – $75/hour
• Parking or occupancy violations – $200
• Any fines or penalties issued by county, HOA, or governing authorities
• Damage repair, replacement, or restoration
• Impacts affecting future guest stays
• Staff labor for remediation, emergency response, or retrieving items
• Any violation of this Agreement
Guest is responsible for all damage and fines, regardless of cause.
Utility & Hot Tub Conservation
Guest agrees to keep hot tub lids fully closed and latched when not in use; avoid introducing sand, glass, oils, or foreign substances; not run heat/AC with doors or windows open; and use reasonable water and power. Guest is responsible for all utility overages or damage resulting from misuse.
Amenities, Hot Tubs & Recreational Equipment
Use of hot tubs, kayaks, bicycles, beach access, water features, decks, and other amenities is strictly at your own risk. Agent and Owner are released from all liability related to recreational equipment or outdoor activity.
Limited Damage Waiver (LDW)
Your reservation includes a Limited Damage Waiver (“LDW”), covering up to $2,000 of accidental damage reported prior to checkout. You must call our office immediately when accidental damage occurs for the LDW to apply.
LDW does NOT cover:
• Intentional or malicious damage
• Excessive or additional cleaning
• Pet damage
• Theft or missing items
• Structural damage
• Guest personal belongings
• Damage from misuse, negligence, or violation of this Agreement
• Hot tub contamination or cover damage
• Damage to structures other than the Property
• Fraud or unreported damage
The LDW is not insurance. Damages exceeding $2,000 or excluded damages will be charged to the credit card on file.
Property Condition, Maintenance & Early Departure
Property is provided AS-IS. Guest must immediately notify Agent of unsafe or problematic conditions. No refunds or compensation are provided for early departure, weather, travel interruptions, emergencies, or utility outages.
Some homes are on septic systems: only toilet paper may be flushed. Wipes, feminine products, diapers, paper towels, or foreign objects will cause damage and resulting repairs will be charged to Guest.
Agent is not responsible for lost, misplaced, or left-behind items. Retrieval may incur staff time plus shipping costs.
Exterior security cameras may be present for security, parking, and occupancy verification. No cameras are located inside the Property.
Indemnification & Hold Harmless
Guest acknowledges that each Guest, including minors under their care, is solely responsible for any accident, injury, illness, or harm occurring on or about the Property. Owner and Agent assume no responsibility or liability, whether based on warranty, contract, tort (including ordinary negligence), premises liability, or any other theory of law.
Guest agrees to indemnify, defend, and hold harmless Owner and Agent from all claims, losses, damages, theft, liability, costs, attorney fees, and expenses arising out of or related to Guest’s occupancy, use, actions, or activities on or around the Property.
If the Property becomes unavailable due to weather, damage, repairs, emergencies, or circumstances beyond the Owner’s control, Agent will make reasonable efforts to notify Guest and offer alternative accommodations when possible. Guest agrees to hold Owner and Agent harmless for any resulting inconveniences or losses.
Credit Card Authorization
By booking, Guest irrevocably authorizes Agent to charge the credit card on file for any unpaid balances, damages, fines, excessive cleaning, unauthorized activity, losses, or any violation of this Agreement. Guest agrees not to dispute charges arising from such violations.
Communication Consent
By booking, Guest agrees to receive communication from Agent by phone, email, mail, or text. Guests may opt out as permitted by law.
Check-In & Check-Out
• Check-in: 4:00 PM
• Check-out: 11:00 AM
Early check-in or late check-out requires prior approval.

Please read your vacation rental agreement carefully before you begin your vacation.
Any monies received by Kiwanda Coastal Properties for occupancy of vacation property indicated the acceptance of the terms of our vacation rental agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental. |
